JPG - Range Rule

Congress passed the Federal Facilities Compliance Act in 1992 requiring the U.S. Environmental Protection Agency (EPA) to issue a rule identifying when conventional and chemical/military munitions are subject to hazardous waste laws and how to manage them.
In response, EPA promulgated the Military Munitions Rule (62 FR 6621) on February 12, 1997. It defines when military munitions become waste subject to Subtitle C of the Resource Conservation and Recovery Act (RCRA) and how these waste military munitions (WMM) will be managed on active and inactive ranges. The Military Munitions Rule became effective at the Federal level on August 12, 1997.
In September 1997, DoD proposed the Range Rule to address the environmental impacts on closed, transferred, and transferring ranges where munitions were used for training, testing, or research and development. The rule outlined several steps to identify, evaluate, and address explosives safety, human health, or environmental risks that UXO on the range might pose.
On November 14, 2000, DoD withdrew the Range Rule. Instead of the Range Rule, DoD will develop the Policy for Closed, Transferred, and Transferring Ranges Containing Military Munitions. DoD will develop a DoD directive and a DoD instruction to provide internal policy and guidance as well as facilitate the programming and budgeting process. The DoD directive and instruction are currently under development.

In support of BRAC closure, the U.S. Army has been addressing the risks posed by the munitions used in support of JPG's mission. The Army will continue to address these risks in conjunction with the DoD directive and instruction after they are finalized.
